These Terms of Service govern access to and use of ProofSite, a local business website builder for collecting proof, generating site drafts, publishing public pages, and receiving leads.
1. Who may use ProofSite
ProofSite is intended for business owners, operators, agencies, and authorized team members. You must be able to enter into these terms and must use ProofSite only for a business or organization you are authorized to represent.
2. Accounts and access
- You are responsible for keeping your account secure.
- You must provide accurate account and business information.
- If you use Google sign-in, you authorize ProofSite to use basic Google profile information to authenticate your account.
- You are responsible for all activity under your account and for team members you invite or authorize.
3. Business content and proof
You are responsible for all business details, testimonials, photos, logos, service descriptions, claims, CTAs, lead forms, and other content you add, import, approve, generate, edit, or publish through ProofSite.
- You must have the rights, permissions, consents, and licenses needed to use uploaded photos, logos, testimonials, and customer content.
- You must not publish false reviews, misleading ratings, fake testimonials, invented awards, unsupported licenses, unlawful guarantees, or deceptive claims.
- You must comply with applicable advertising, privacy, consumer protection, platform, and professional rules for your business.
4. Google Places helper
ProofSite may offer an optional Google Places helper to prefill business details and limited source-labeled references. This helper is not a full Google review sync. You must review, edit, approve, and publish only content you are allowed to use. ProofSite does not grant rights to Google content beyond what Google and applicable law allow.
5. AI-generated drafts
ProofSite may use AI to extract proof themes and generate website drafts. AI output can be inaccurate, incomplete, or unsuitable for a particular business. You must review and approve generated content before publishing. ProofSite does not guarantee search ranking, conversions, accuracy, legal compliance, customer responses, or business results.
6. Public pages and leads
Published ProofSite pages are public. Visitors may submit lead forms, testimonial forms, or lightweight interaction events. You are responsible for responding to leads, handling visitor information lawfully, and honoring any consents or requests from visitors.
7. Acceptable use
You must not use ProofSite to:
- Violate laws, regulations, third-party rights, or platform policies.
- Upload malware, spam, deceptive content, or abusive content.
- Attempt to bypass security, rate limits, or access controls.
- Scrape, copy, or misuse other users' data or public submissions.
- Misrepresent your identity, business, customer feedback, credentials, or affiliations.
8. Third-party services
ProofSite may integrate with third-party services for authentication, hosting, email, analytics, AI generation, Google Places, and payment processing. Third-party services may have their own terms and privacy policies. ProofSite is not responsible for third-party services it does not control.
9. Payments and subscriptions
ProofSite may offer free, trial, or paid plans. Any paid plan terms, prices, renewal periods, cancellation rules, and taxes will be shown at checkout or in the product when billing is enabled. You authorize ProofSite and its payment providers to process charges for paid plans you choose.
10. Ownership
You retain ownership of content you submit to ProofSite. You grant ProofSite a license to host, store, process, reproduce, display, and distribute that content only as needed to operate, improve, secure, and provide the service. ProofSite owns its software, design system, workflows, templates, documentation, and service materials.
11. Suspension and termination
ProofSite may suspend or terminate access if an account violates these terms, creates risk for the service, infringes rights, causes abuse, or is required by law. You may stop using ProofSite at any time and may request account deletion.
12. Disclaimers
ProofSite is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ProofSite disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and guaranteed business results.
13. Limitation of liability
To the maximum extent permitted by law, ProofSite will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost leads, reputational harm, or business interruption arising from use of the service.
14. Changes to these terms
ProofSite may update these terms as the product, providers, or legal requirements change. Continued use after updated terms are posted means you accept the revised terms.
